"Blowing the Whistle harder: Enhancing Whistleblower Project" is financed by European Comission and run in cooperation with
Transparency International. Within the project TI Latvia will prepare a report and work on improving national regulations.
Aim of the report is to provide an overview of country's laws and practices related to the Whistleblower (herein after - WB) protection in the public and private sector:
- to identify the laws that include regulations affecting the role and status of WB in the public and private sector;
- to investigate and analyze the cases of exercising WB in practice;
- to describe the socio-cultural context that has the effect on the understanding and practical implementation of developing sound WB regulations and practice in the country.
Definition of ‘WB'There are two definitions which are applied to WB:
- The broader definition focuses on a WB as a former or current insider of an organization (an employee, member, etc.), which discloses illegal or illegitimate practices to persons who may be able to effect action.
- A more narrow definition considers a WB as a former or current insider of an organization (an employee, member, etc.) who discloses illegal or illegitimate practices and is driven by public interests only. (Note: the WB discloses information not because he/she might face criminal or administrative discipline or receive remuneration, but because the person is concerned with elimination of wrongdoing and/or general public interests).
Due to the fact that previously done researches indicate a rather limited application of WB within the scope of narrow definition, within the report WB is assessed in the most extensive way (a broader definition on the WB); however, at the same time the attempt is made to identify the cases with a more narrow application of WB.
